Thelandofpapua.com – Indonesia and Singapore have commenced the implementation of a progressive fugitive extradition agreement, aiming to bolster cooperation in combating cross-border crimes. The agreement, hailed by Law and Human Rights Minister Yasonna Laoly as a significant step forward, encompasses a range of criminal activities and incorporates mechanisms to address evolving challenges in law enforcement.
In a statement released by the Ministry of Law and Human Rights, Minister Yasonna Laoly emphasized the forward-looking nature of the extradition pact. “The Indonesia-Singapore extradition agreement is progressive and flexible for (handling) acts of crime in the present and future,” he stated, highlighting its adaptability to contemporary and emerging criminal trends.
The extradition agreement comprises 19 articles, delineating the procedures for the extradition of individuals sought for prosecution, trial, and sentencing for various criminal offenses. Among the offenses covered are corruption, money laundering, bribery, banking crimes, narcotics-related offenses, terrorism, financing of terrorism activities, and other crimes stipulated by the laws of both countries.
Notably, the agreement features a unique provision concerning the nationality of perpetrators. Under this provision, a fugitive’s nationality is determined at the time the criminal act is committed, aimed at thwarting attempts by criminals to evade justice by altering their citizenship.
Minister Laoly elucidated that the extradition pact adheres to the retroactive principle for up to 18 years, in accordance with Article 78 of the Criminal Code. This provision is designed to address criminal acts committed prior to the agreement’s enactment, ensuring accountability for past offenses.
Expressing optimism about the agreement’s impact, Minister Laoly urged law enforcement agencies to promptly utilize its provisions to deter criminal activities and prevent fugitives from escaping justice. The agreement officially came into effect on March 21, 2024, following its signing by Minister Laoly in Bintan Island on January 25, 2022.
